Virginia and California Patients File Suit Against DePuy

Lieff Cabraser attorneys Wendy Fleishman and Lexi Hazam announced that George Evans of Remington, Virginia, and James Mechaley of Bakersfield, California, have filed suit against DePuy for injuries they suffered after receiving defective DePuy ASR hip implants.

George Evans of Remington, Virginia, spoke about the constant pain he endures from his faulty DePuy hip implant: “It’s been a lot of pain. Over the holidays, on Christmas eve, I did not sleep all night because of the discomfort.”

Lexi Hazam explained that the complaint “charges that DePuy was aware its ASR hip implant was failing at a high rate, yet continued to manufacture and sell the product to unsuspecting physicians and patients.” The currently accepted margin of failure for hip implants dictates that no more than five percent of devices require revision surgery within five years; the complaint filed on behalf of Evans and Mechaley alleges that the DePuy ASR’s failure rate was as high as thirteen percent.

Yesterday, The New York Times examined the likelihood that the failure rate of the DePuy ASR may jump significantly higher than thirteen percent. 40,000 U.S. patients received DePuy ASR hip implants before Johnson & Johnson issued its 2010 recall of the device. The U.S. does not currently track the number of failed metal-on-metal hip implants, but Dr. Art Sedrakyan, a researcher at Weill Cornell Medical College of Cornell University used data from other countries to estimate that the next decade will yield “tens of thousands” of U.S. patients needing revision surgery for their metal-on-metal hip implants.
